"Memorial of the Last Will and Testament of the Rev.d Walter Atkin ofBallinleaden otherwise Leadentown in the County of Cork Clerk made in theWords following, to Wit, in the name of God Amen I The Rev.d Walter Atkinof Ballinleaden otherwise Leaden Town in the County of Cork Clerk beingsomewhat Infirm in Body but of Sound and Disposing Mind and Memory (thanks to almighty God) do make this my last Will and Testament in mannerfollowing first I Commend my soul to Almighty God who gave it, and myBody I Commit to the Earth, in sure and certain hopes of a JoyfullResurection thro.e the Merits of my lord and saviour Jesus Christ, To beBuried in Such manner as my Executor hereinafter Named shall think fitt,and as touching such Worldly Estate as it hath pleased God to bless mewith I Dispose of the same as followeth, I give Devise and bequeath untomy Eldest Son the Rev.d John Thom.s Atkin Clerk my Real Estate of theTownLands Tenem.ts & Hereritam.ts of Ballinleadin otherwise Leadentownaforesaid Subject nevertheless to the several Charges and Incumbrances ashereinafter ment.d To hold unto him during his Natural Life and after hisDecease I give Devise and bequeath the Same Subject as aforesaid unto myGrandson Walter Atkin for and during his Natural Lifeand after his Deathto the Eldest Son of the Body of my said Grandson lawfully to be begottenand the heirs Male of his body respectively and for want of such heirsMales to every other Son and Sons of the body of my Grandson to belawfully begotten and the Heirs Males of their Respective bodies lawfullyto be begotten the Eldest of such Sons, and the heirs Males of his bodyrespectively to take and be preferred before the younger of such sons andthe heirs ~~ Males of his, And in default of such Issue in my saidGrandson I give devise and bequeath my s.d Real Estate to all and everyother Son & Sons of my said Son John Tho.s Atkin Lawfully to be begotten,Subject Still as afores.d as they shall be in Seiority of Age andpriority of birth respectively, and to the heirs Males of their bodiesrespectively the Elder of Such Sons, and the heirs Males of his and theirBodys Always to be preferred before the younger and his heirs males, Andin Default of such Issue in my said Son John Thomas Atkin and in my s.dGrand Son Walter Atkin as afores.d if my Second Son Conningsby Atkin doand shall forthwith and within One Month after Application be made orNotice Given him, turn away Discharge and Abandon a certain Woman CalledDorcas Roche otherwise Clarke who is now sayed to keep In his house andthereof within the said Time shall give a reasonable Satisfaction orProof to his parish Minister my said Son John Thomas Atkin, And alsoshall Reasonably Satisfie his said parish Minister that he will notthenceforth in anywise Entertain hold or keep up any further Acquaintanceor Correspondance with her this Dorcas Roche Otherwise Clarke That thenand on such Condition in default of such Issue as afores.d I leave andDevise my said Real Estate Subject Still as afores.d unto my said SonConningsby Atkin during his Natural Life And after his Death of his bodyto the heirs Males ^ lawfully to be begotten, but in Case my said SonConningsby Atkin shall not fullfill & perform the aforesaid Conditionaccording to the true intent and meaning thereof Then my Will is that hemy s.d Son Coningsby Atkin be and is hereby Accordingly for ever Debarredand Exclude from Succeeding to my said Real Estate And in Such Case uponFailure of Issue Male in my said Son John Thomas Atkin And in my saidGrandson Walter Atkin as aforesaid my said Real Estate shall immediatelygo to And be Enjoyed by my Son Doctor William Atkin during his NaturalLife And after his Death by the heirs Males of his body lawfully to bebegotten or if my s.d Son Conningsby Atkin shall perform the afores.dCondition, And thereby Succeed to my said Estate but shall afterwardshappen to dye leaving no Issue male of his body lawfully ~ to be begottenI will Devise and bequeath that after his Death and in Default of suchIssue male in him My said Real Estate Subject as afores.d shall beEnjoyed by my said Son Doctor W.m Atkin during his natural life, Andafter his Death by the heirs Males of his body lawfully to be begottenAnd for want of such Issue in my said Son Will.m
Atkin I Devise my said Real Estate Subject still as afores.d to my heirsat law. Item I leave and bequeath unto my afores.d Son Conningsby Atkinthe bond which he perfected to me for one hundred pounds Ster, and allthe due interest ^ thereon ~~ Item I leave unto my said Son William Atkinthe Sum of One hundred pounds Ster. Item I leave unto Each of my twoDaugh.s Barbara & Elizabeth Atkin the sum of Five hundred pounds Ster. Astheir Marriage portions, And likewise to each of my two Daughters I leavethe further Sum of two hundred pounds Ster: provided they shall Accept ofthe Same in full Satisfaction & Discharge of any Claim Challenge orDemand they or either of them may have against me for or by reason of anyLegacy or Legacys heretofore left them by any person or persons or for byany reason of any other Account whatsoever Otherwise I leave the said Sumof two hundred pounds Ster. bequeathed as Aforesaid to each of my s.d twoDaughters unto my son John Tho.s Atkin Afores.d. Item I leave unto myDaughter Catherine Wydenham five pounds Ster and unto my Grand DaughterElizabeth Wydenham I leave the sum of fifty pounds Ster.. for ten years next after my Death to be Distributed in WhitSun Week atthe Discretion of my Executor, Item I Order Direct and Appoint and myWill is, that in Case my personal Fortune shall not be the sufficient toanswer and Discharge all my Just Debts & ^ Several Legacys hereinbeforebequeathed such Deficiency in my said personal Fortune shall be made goodout of my Real Estate of Ballinleaden
Otherwise Leadentown afores.d and I do hereby Accordingly Subject & ~charge my s.d Real Estate to and with the payment of any Such ~Deficiency as afores.d And it is further my Will that Whatever Sum or
Sums of money any or Either of my s.d Sons or my said Grandson or theheirs Males of any or Either of my s.d Sons or of my s.d Grandson to whommy s.d Real Estate shall come by virtue of this my Will, shall by forceof the foregoing Clause first pay in Discharge of any of my Debts or ofany ~ Legacy or Legacys hereinbefore bequeathed Such Son or Grandson orthe heirs Males of such Son or Grandson So paying as afores.d his andtheir respective Exec.rs Adm.rs and Assigns shall have recover andReceive out of my said Real Estate from the person or heir nextImmediately Succeeding thereto any such Sum or Sums of Money as shall befirst so paid as As afores.d And that such person or heir nextImmediately Succeeding his Ex.rs Adm.rs & Assigns shall be reimbursedhave and recover the said Sum or Sums of money out of my s.d Real Estatefrom the person or heir Again next ^ Succeeding thereto And so on in likemanner Continually for Ever And I Do Order devise and Appoint that suchs.d Sum or Sums of money so to be first paid & from time to time to beReimbursed in manner as aforesaid shall stand and Remain for ever a goodand Effectuall Charge and Incumbrance upon my s.d Real Estate in thehands of whomsoever my said Real Estate shall come to be by virtue ofthis my Will or Otherwise Howsoever & whereas I Stand Indebted unto myAforesaid Son John Thomas Atkin by my bond duly perfected under my handand Seal in the sum of Six hundred pounds Ster. being his Marriageportion On his Intermarriage with his present Wife I do by this my Willfurther Order devise and Appoint that in Case my personal
