1737 - Ref 84-370-61133 - Memorial of a Tripartite Deed of Indenturebearing date 7 May 1737 made and executed between John Hayman ofCloynpriest in the county of Cork Gentleman John Hayman and SamuelLuther both of the town of Youghal in the county of Cork GentlemenAdministered with the Will annexed of John Hayman late of Polemore in thecounty of Cork deceased of the first part and Samuel Atkin of Coolamainin the county of Wexford Gentleman of the second part and Annesley Goreof Cottenstown in the county of Sligo Esq of the third part Recitingthat Charles Tottenham of Tottenham Green in the county of Wexford Esq byIndenture of Lease dated as in the annexed said Tripartite Deed asrecited did demise unto the said Samuel Atkin the Towns and Lands ofCoolamain Oyle and Rahaile containing 924 acres or thereabouts for yeterm of three lives with a Clause of Renewal for Ever and the lands ofBallyruan containing 51 acres or thereabouts during the term the saidCharles Tottenham had of the same being in the Barony of Ballaghkeen andcounty of Wexford at the yearly rent of £204 sterling Which Deed ofLease was in consideration of the several sums of £141-3-0 and of thefurther sum of £344-0-0 advanced and lent by the testator John Hayman tothe said Samuel Atkin as by endorsement on the back of the said Deed ofLease may apprear Assigned to the said Samuel Atkin to the said JohnHayman of Cloynpriest John Hayman and Samuel Luther of Youghal by andwith the consent and direction of the said Samuel Atkin testified by hisbeing a party to said Tripartite Deed in consideration of the sum of £300sterling to them or any of them in hand paid did grant bargain sellassign and make over unto the aforesaid Annesley Gore Esq his heirs excrsadmons and assigns their right title interest claim and demand both inLaw and Equity in and to the said Deed of Lease aforesaid and assignmentthereon as in said Tripartite Deed reciting several other covenants asrecited And the said Deed was duly signed sealed and delivered by thesaid Samuel Luther in the presence of Thomas Cuffe Esq and RichardBrowning Gentlemen both of the City of Dublin who are subscribingwitnesses to the said Tripartite Deed whereof the above is a MemorialAnd this Memorial is witnessed by the said Richard Browning and ThomasWelsh Junior Samuel Luther (seal) Signed and sealed in the presence ofus Richard Browning Thomas Welsh Junior

1740 - Ref 100 - 262 - 70420 - Memorial of Deeds of Lease and Releasebearing dates 14 and 15 November 1740 and made between Samuel Atkin ofCoolamain in the county of Wexford Gent and Annesley Gore of Castletownin the county of Sligo The said Deed of Release reciting that byIndenture of Lease bearing date 4 May 1723 Charles Tottenham of TottenhamGreen in the county of Wexford Esq did demise and set unto Samuel Atkinall that and those the Towns and Lands of Coolamain Oyle and Rahailecontaining by estimation 924 acres And also the Towns and Lands ofBallyruan containing 51 acres more or less All which lands are situatelying and being in the Barony of Ballaghkeen and county of Wexford withthe appurtenances To hold the said lands of Coolamain Oyle and Rahaileunto the said Samuel Atkin his heirs excrs admons and assigns for andduring the natural life and lives of the said Samuel Atkin Walter Atkinand John Atkin the sons of him the said Samuel Atkin and the survivorsand survivor of them And to hold the said Lands of Ballyruan unto thesaid Samuel Atkin his excrs admons and assigns from the first day of Maythen last past before the date of the said Lease for and during such termof years as the said Charles Tottenham his heirs excrs and admons had ofthe same by virtue of a Lease from Richard Saunders Esq and no longerHe the said Samuel Atkin his heirs excrs and assigns yielding and payingto the said Charles Tottenham his heirs excrs admons and assigns the rentor sum of £204 sterling by half-yearly portion clear above all taxes andquit rents Crown Rent excepted In which said lease are containedcovenants for renewal forever on payment of one peppercorn as a fine onthe fall of each and every life as is therein particularly expressed anddeclared By which said Deed of Release the said Samuel Atkin for theconsiderations therein mentioned did grant bargain sell release assignand make over unto the said Annesley Gore his heirs excrs admons andassigns the said recited lease for the premises thereby demised and allthe estate Right Title and interest of the said Samuel Atkin his heirsexcrs and assigns in and to the same which said Deed of Lease and Releaseand this Memorial are witnessed by Saunders Frayne of Ballylicken in thecounty of Wexford Gent and John Perkins of the City of Dublin GentSamuel Atkin (seal)
